01Who can drive the vehicle
Clause 2.1
Authorised Drivers
Only drivers authorised by Us before the Start of the Rental are permitted to drive the Vehicle.
Major Breach. Allowing an unauthorised driver to drive the Vehicle excludes You, an Authorised Driver and the unauthorised driver from the benefit of Damage Cover for Accidents and theft of the Vehicle.
Clause 2.2
Age limits
The minimum permitted age is 21 and the maximum age is 80. Drivers aged 21 to 24 pay an additional Damage Excess of $500. Note: P1 (red) probationary licence holders are not permitted to drive the Vehicle regardless of age. P2 (green) probationary licence holders are permitted — see clauses 2.3 and 2.4.

Licence requirements
A current, valid, full (unrestricted) licence or a P2 (green) provisional or probationary licence is required. Learner licence holders and P1 (red) provisional or probationary licence holders are NOT permitted to drive the Vehicle. Licences must not be subject to any restriction, cancellation or suspension.
Clause 2.5
Prior insurance and claims history
The Vehicle must not be driven by anyone who, within the previous 3 years, has been refused motor insurance, had a policy cancelled, had a claim refused, had special conditions imposed, committed relevant criminal acts, been declared bankrupt, or had a driver's licence suspended, cancelled or restricted.
02How the vehicle can be used
Clause 3.1
Prohibited driving
The Vehicle must never be driven under the influence of drugs or alcohol, in excess of legal limits, or in a manner that breaches road safety legislation or any local law.
Clause 3.2
Prohibited use
Failing to undergo a preliminary breath test, illegal use, using the Vehicle to move dangerous or hazardous goods, use of a mobile phone whilst driving, and road rage or any deliberate malicious act are all prohibited.
Clause 3.3
Prohibited actions
Deliberately damaging or modifying the Vehicle is prohibited, and carrying passengers for hire, fare or reward is not permitted without our prior approval (except under private pooling or via a ride share/food delivery platform).
03Where the vehicle can go
Clauses 4.1, 4.2
Prohibited areas
Use of the Vehicle on Unsealed Roads and Off Road is prohibited at all times, as is use of the Vehicle in a prohibited area, including flooded roads, beaches, driving through rivers or streams and any areas prohibited by the police.
Clause 4.3
Permitted geographic area
The Vehicle may only be driven in Queensland and New South Wales. Driving in any other state or territory, or onto any island off mainland Australia, requires prior written approval noted on the Rental Agreement.
04During your rental
Clauses 5.2, 5.3
Start of the Rental
You must inspect the Vehicle at the Start of the Rental for pre-existing damage and sign a Handover Inspection Report. Damage not shown is deemed to have been caused during the Rental Period. You must pay the Security Deposit and the Rental Charges for short-term rentals, or the first month's Rental Charges for Longer Term Rentals.
Clause 5.5
Prompt payment of Hire Charges
All Hire Charges must be paid when due. Any payment overdue by 14 days or more is a Major Breach allowing Us to terminate the Rental Contract and repossess the Vehicle.
Clause 5.6(b)(ii)
Smoking
You and any passengers must not smoke in the Vehicle. Extra cleaning fees apply.
Clause 5.8
Locking the Vehicle
The Vehicle must be locked when not in use or unattended, and the keys are to be kept in Your possession at all times.
Not covered. Theft with the keys left in or accessible to the thief is not covered.
Clauses 5.9, 5.11
Reasonable care and faults
During Your rental You must take reasonable care of the Vehicle. You must notify Us of any Vehicle fault, warning light or fault message or low fluid levels.
Clause 5.10
Maintenance for long term rentals
Although We will pay for maintenance of vehicles on longer term rentals, You must return the Vehicle for scheduled servicing at the intervals set out in the Terms and Conditions.
Clause 5.15
Duty of Disclosure
You must disclose to Us any information relevant to Our decision to enter into the Rental Contract with You. Failure to disclose may allow Us to terminate the Contract, reduce the amount of any claim, or treat the Contract as though it never existed if the failure is fraudulent.
Major Breach. Breach of the Duty of Disclosure is a Major Breach.
Clause 6.2
Rental extensions
Extensions of the Rental Period must be notified no less than 24 hours prior to the End of the Rental.

Tolls, fines and infringements
You must pay for all tolls, parking fines and infringements and fines for speeding and other driving offences.
Clause 6.6
Daily km limit
Daily use is restricted to 300 kilometres. Any use over and above that limit will be charged at 40 cents per excess kilometre.
05Damage Excess & Cover
Clause 7.1
Standard Damage Excess
The standard Damage Excess is $1,500 (including GST). If there is Damage to the Vehicle, it is stolen or there is any Third Party Loss, You must pay the Damage Excess. Loss of Use liability is additional to Your Damage Excess liability.
Clause 7.3
Younger driver additional Excess
Drivers aged 21 to 24 pay an additional Damage Excess of $500 (total $2,000).
Clause 7.3A
P2 (green) additional Excess
P2 (green) provisional or probationary licence holders pay an additional Damage Excess of $1,000, in addition to any other Damage Excess amounts (including the younger driver loading under clause 7.3).
Clause 7.4
Fire, theft & total loss Excess
For claims relating to fire, theft, attempted theft, or total loss of the Vehicle, the Damage Excess is $2,500 (including GST).
Clause 7.5
No-liability Damage Excess
The standard $1,500 excess applies to hit-and-run incidents, animal-strike accidents where no third party is liable, and driver-error accidents.
Clause 7.6
Third-party details Excess
If You fail to obtain the Third Party's rego, name, contact number and address after an Accident, You are liable to pay an additional Damage Excess equal to the amount Our insurer charges Us for that failure.
Clause 7.7
Longer Term Rental early claim loading
For Longer Term Rentals, an additional $500 loading applies to at-fault Accidents in the first 3 months of the Rental Period.
Clause 7.10
Optional Hail Cover
Hail damage is NOT covered by default. You may opt in to Hail Cover for an additional $10 per week added to Your Rental Charges. If elected, hail damage is covered subject to a $3,000 Damage Excess.
Clause 7.11
At-fault replacement vehicle
If the Vehicle is undriveable after an at-fault Accident, We will provide a replacement vehicle at no additional cost for up to 2 weeks, subject to availability. If a replacement is not available, compensation of up to $400 (food delivery vehicles) or $700 (ride share vehicles) applies.
Clause 7.12
Claims Administration fee
All Accident, attempted theft and theft claims incur a $100 claims administration fee in addition to the Damage Excess.
Clause 8.1
Damage Cover Exclusions
Damage Cover is excluded if there is a Major Breach.
Also excluded. Overhead Damage, Underbody Damage, water immersion, wrong fuel, tyre/rim damage other than fair wear and tear, windscreen and window damage, hail damage (unless Hail Cover purchased), electrical or mechanical faults (including resulting fire), fraud/deception/repossession, breaches of local law, theft where keys were left with the Vehicle, and leaving the Accident scene before police attend.
Clause 8.3
Personal items
There is no Damage Cover for lost, damaged or stolen personal items.
06Roadside & accidents
Clause 9.1
Roadside assistance
24-hour roadside assistance is included at no additional charge. Cover includes battery repair/replacement, flat tyre assistance, out-of-fuel help, lost/stolen/locked-in keys, and cover for electric, hybrid, petrol and diesel vehicles. Up to 20km metro towing (or nearest country service centre) is included. Accident towing is capped at 100km from the Accident location.
Clause 9.2
Assistance not covered
Roadside assistance does not apply where the wrong fuel is used, where a Major Breach caused the breakdown, or where the request relates to an Accident (in which case Accident reporting obligations apply).
Clauses 10.1, 10.2
Accident reporting
Any Damage to the Vehicle during the Rental Period must be reported to Us within 24 hours. You must also report an Accident to the police if any person is injured, a party leaves the scene without exchanging details, or the other party is affected by alcohol or drugs.
Clause 10.3
Steps at the Accident scene
You must exchange all details with the other driver including their name, address, contact details, insurance company, licence photo and vehicle registration; and take photos of the scene. Failure to obtain full Third Party details may result in an additional Damage Excess under clause 7.6.

Co-operation
You must co-operate with Us in the investigation of an Accident or theft claim and with any subsequent legal proceedings.
07Return, breach & privacy
Clause 11.1
Return of the Vehicle
The Vehicle must be returned on time, in clean and good repair and with a full tank of fuel or additional fees will apply. Unless otherwise stated, the Rental Period is 24 hours. If the Vehicle is returned more than one hour after it is due, You will be charged $25 per hour up to a full day's rental and a further full day's rental for each 24 hour period or part thereof.
Clause 12.1
Major Breach, Termination
Damage Cover is excluded if You or an Authorised Driver commit a Major Breach or drive the Vehicle recklessly. If there is a Major Breach the Vehicle may be repossessed.
Clause 15.2
Privacy / Tracking Device
A Tracking Device may be fitted to the Vehicle to track its location and record its route of travel, and may provide other data about the use of the Vehicle. It must not be removed.
